Appeals court overturns dismissal of DynCorp case

The U.S. Court of Appeals for the Eleventh Circuit this week reversed the dismissal of DynCorp International's complaint against AAR Airlift Group.

According to the court decision, filed Nov. 21, DynCorp had asserted "trade-secret misappropriation and other claims" against AAR Airlift Group, a competitor.

The complaint centers around the State Department's Worldwide Aviation Support Services program, according to the document. DynCorp, in court documents, alleged AAR hired several former DynCorp employees and then used DynCorp trade secrets to bid against the company.

DynCorp filed suit more than a year ago in federal district court, alleging AAR violated the Florida Uniform Trade Secrets Act and engaged in common-law conversion and tortious interference, among other allegations.

The court dismissed the complaint, the latest court decision notes, and DynCorp appealed it.

The new decision reverses the dismissal and "remand[s] the case for proceedings consistent with this opinion."
